PESHAWAR, Jan 18: The Peshawar High Court on Wednesday sought comments from the provincial government in a writ petition challenging the creation of the post of special secretary health and appointment of a professor against the said post.

A two-member bench comprising Justice Mian Fasihul Mulk and Justice Azmatullah Malik fixed Feb 8 for next hearing of the case, directing the government and special secretary to file comments within a week. The petition is filed by Dr Shahsawar Khan and Dr Waseem Anwer, both leaders of Provincial Doctors Association, stating that Prof Noorul Aiman, special secretary health, was occupying three posts at a time.

Advocate Farmanullah Khattak appeared for the petitioners and contended that Prof Noorul Aiman was serving at Khyber Teaching Hospital when a notification was issued by the provincial chief secretary on Oct 19, 2010.

He added that through the said notification it was mentioned that he had been transferred and posted against the post of special secretary health with immediate effect. — Bureau Report
