HYDERABAD, Nov 25: The circuit bench of the Sindh High Court on Monday issued notices to two petitioners on an application filed by the MNA-elect from Sanghar, Mohammad Khan Junejo, to appear on Nov 27.
The notices were issued at the hearing of a constitutional petition, filed on behalf of Inayat, Mohammad Hussain, and Urs, all residents of the Mulla Makhan village, Koral Qadeer Deh, Sanghar.
They had accused the MNA-elect of having never studied regularly in any college or university, adding that he had mainly devoted his time in recreation and looking after his father’s lands.
Earlier, the respondent had filed an application under Article 199 of the Constitution read with Section 151 of the Civil Procedure Code.
The counsel for the respondent had submitted in the application that the court, after hearing the arguments of the counsel for the petitioners and respondent on Nov 15, had reserved the order in the petition.
He said that his client had made a representation before the chancellor of the University of Sindh on Nov 18, requesting for constitution of a high-powered committee to examine the genuineness of the degree conferred upon him and had prayed for suspending the notification, issued by the university’s assistant controller of examination declaring his degree to be bogus, till the submission of the report by the committee.
The respondent counsel had said that the chancellor had accepted his client’s representation and had issued orders to ascertain the genuineness of the notification issued by the assistant controller of examination.
He also informed the court that consequent to the acceptance of Junejo’s request by the chancellor, it had become necessary to place relevant documents/information on record of the court.
The counsel had prayed the court to take on record and consider the representation made to the chancellor and orders, dated Nov 18, passed by the chancellor of the university, and issue notices to the parties concerned, if it deemed fit, prior to the final adjudication and pronouncement of the judgment.
In his representation to the chancellor, the MNA-elect had stated that he had appeared for the BA (pass) Part I and II examinations at Shahdadpur in 1984 and 1985 respectively, and, on the basis of the examination results, the competent authority had issued answer copies to the University of Sindh that were examined and scrutinized, which had culminated in the issuance of the verified mark sheets of BA Part I and II.
He said that the undersigned was conferred upon with the degree of Bachelor of Arts on the basis of the mark sheets.
Terming the move, made by his client’s rival, Fida Hussain Dero, malicious he said that Dero had moved the University of Sindh and had succeeded in obtaining a notification reflecting the degree of the undersigned to be bogus.
This entire process, the counsel said, was engineered and manoeuvred by his client’s rival candidate to prevent Junejo from taking the oath of office in the National Assembly.
The application has been fixed for hearing on Wednesday.
