LAHORE, Sept 2: Continuing his arguments on Pakistan Lawyers Forum’s writ petition, Counsel A.K.Dogar submitted before Mr Justice M Javed Buttar of the Lahore High Court on Monday that President Gen Pervez Musharraf had issued the Legal Framework Order in violation of the Supreme Court judgment in the Zafar Ali Shah case.
He said that the LFO had been issued to amend the Constitution which had not been permitted in the Zafar Ali Shah case judgment. He said that only an elected parliament was competent to amend the Constitution. President Musharraf was not an elected person and had thus no mandate to make amendments to the Constitution.
He submitted that the Supreme Court had allowed the government to make rules for running the country during the transitory period after which the power was to be transferred to the elected government. But the president had acted against his declared objective of taking steps for transferring power to the representatives of the people by holding a referendum for his own election and lost the confidence of the people.
He contended that the constitution of the National Security Council was an attempt to involve the armed forces in the civil matters in violation of the spirit of the Constitution.
Mr Dogar will continue his arguments in the case on Tuesday (today).
