PESHAWAR, April 5: A sub-inspector of traffic police, accused of injuring a citizen, was arrested on Friday after his pre-arrest bail application was turned down by a local court.
The accused, Kishwar, had fired on a citizen, Izhar Khan, on March 13 near Shabistan Cinema here, which resulted in fracturing his both arms and legs.
The applicant was earlier allowed interim pre-arrest bail and Friday was fixed for its confirmation. The additional district and sessions judge, Hussain Bahadur Khan ruled that the applicant was not entitled to pre-arrest bail.
Advocate Ishtiaq Ibraheem appeared for the complainant, Izhar, and argued that evidence connecting the applicant to the commission of the offence was available.
He contended that the complainant received serious injuries and there were four bullet wounds on his body. He added that both arms and legs of the complainant got fractured and he was admitted to the hospital in critical condition.
Mr Ibraheem stated that the offence fell in the prohibitory clauses of Criminal Procedure Code and the accused was not entitled to bail.
Advocate Gulzar Khan appeared for the applicant and contended that the applicant was falsely implicated in the case.
He stated that it was a cross case as the complainant had also attacked the applicant who was on official duty.
The incident had occurred near a traffic signal. The complainant claimed that the said traffic cop abused him and during exchange of hot words he took out his pistol and fired on his arms and legs.
The concerned police was reportedly reluctant to register an FIR, but after the interference of the District Nazim an FIR was registered under section 324 of Pakistan Penal Code.
