KARACHI, July 15: The Sindh High Court on Thursday issued notices to the advocate-general and the home department for July 26, on a petition filed by Orangi Town Nazim Shahid Alam challenging his detention under MPO.

Orangi Town Nazim famously known as "Gudoo Behari" submitted he was being politically victimized as initially he was booked under false cases and when he was enlarged on bail in all cases, the provincial government detained him on June 25, under MPO for one month without any reason.

He alleged that all actions against him were being taken on directives of the Muttahida Quami Movement which was bent upon creating hurdles in developments works in Orangi.

His counsel Khawaja Naveed Ahmed prayed that the detention of Shahid Alam under MPO be declared illegal and his release be ordered forthwith. SHC's division bench, comprising Justice Anwar Zaheer Jamali and Justice Gulzar Ahmed, after preliminary hearing issued notice to respondents for July 26.

NOTICE TO STATE: A division bench of Sindh High Court, comprising Justice Syed Ali Aslam Jaffery and Justice Muhammad Afzal Soomro, on Thursday admitted for hearing the appeal of two convicts filed against their conviction in a kidnapping for ransom case and issued notice to the state.

Two brothers Shahid and Zahid were sentenced to death by the Anti- Terrorism Court Karachi on June 23, with confiscation of their property worth Rs100,000. They were prosecuted on charge of kidnapping Amir Haroon from SITE area Karachi for ransom.

According to prosecution, accused kidnapped Amir, a factory manager on March 22, and demanded Rs1 million from detainee's family as ransom. Police arrested them red-handed outside bank near Shaheen Complex where they went to withdraw a cheque of Rs980,000 which was obtained from abductee's family.

The court was prayed to set aside the conviction of appellants. Meanwhile, the same court sent Mohammad Nadeem to jail on his failure to furnish surety. The court was hearing the state appeal against acquittal of Nadeem as he was exonerated by the ATC on September 25, 2001, in a sodomy case for want of evidence.

He was prosecuted on charge of allegedly sodomising a boy Wahid Ahmed on May 15, 2001, in the limits of Brigade police station. Earlier, the respondent was directed to furnish surety in the sum of Rs50,000 within 15 days on April 2, but he failed to do so.

The court, sending him to jail on failure of furnishing surety, ordered that release writ shall be issued to respondent if he furnishes surety in compliance of court order and adjourned the matter for Aug 13.

COMMENTS SOUGHT: A division bench of Sindh High Court, comprising Justice Anwar Zaheer Jamali and Justice Gulzar Ahmed, on Thursday sought comments from federal and provincial governments on petition of Haji Gul Ahmed seeking direction to formulate all existing laws of country according to Quran and Sunnah.

Petitioner citing Federal Law Ministry, Pakistan Muslim League, Muttahida Majlis-i-Amal and Alliance for Restoration of Democracy (ARD) as respondents in his constitutional petition prayed to the court to issue directions for formulation of all existing laws in the country according to Quran and Sunnah.

He also prayed that respondents be directed to present the bill before the parliament. The court, issuing directions to provincial and federal law attorneys for filing comments, adjourned the matter for date to be fixed by office. -PPI
