KARACHI, July 8: The Sindh High Court issued notices to the provincial local government department in a petition against the Gulshan-i-Iqbal and Liaquatabad town administrations for not allowing a grade-18 officer to join as deputy town officer.

Engineer Shakeel Mughal submitted through Advocate M. Nawaz Shaikh that he joined the local council service as an assistant executive engineer in 1985. He was serving as deputy town officer of the Baldia Town's engineering department when the post was abolished in August 2002.

He reported to the Gulshan-i-Iqbal Town administration for duty as directed by the local government department. The administration declined to let him join as, according to it, there was no grade-18 post in its maintenance and engineering department.

He was asked to report to the Liaquatabad Town administration, which also refused to appoint him as deputy town officer. The petitioner's counsel claimed that a post was available with both the town administrations, which were bound to accommodate him.

The petitioner has not received his salary for the last 22 months and was being refused posting on false pretexts. The grievance did not fall within the purview of 'service matters' and the jurisdictional bar contained in the Constitution did not apply.

He had no remedy but to invoke the high court's writ jurisdiction. A division bench, comprising Justices Anwar Zaheer Jamali and Gulzar Ahmed, issued notices to the respondent department for a date to be fixed by office.

BAIL PLEA REJECTED: Justice S. Ali Aslam Jaffrey of the Sindh High Court on Thursday rejected the bail applications of two applicants involved in a motorcycle snatching and murder cases, add APP/PPI

According to prosecution, Ashique Hussain, booked under Section 392/397/ 353/324 and 34 PPC by the Orangi Police, sought bail in a motorcycle snatching case. He was arrested red-handed on Jan 11, 2002, along with co-accused Mohammad Yasin and Rajoo.

The accused moved the trial court (ADJ-I, West) which rejected the bail plea on March 16. The SHC bench, after hearing the two sides, rejected the instant bail application having no merits or ground.

The same bench also rejected the bail application of Mohammad Inayat who sought bail in a murder case. According to prosecution, one Mumtaz Soomro informed the Airport police on March 21,1999, that a body is lying behind ASF Hospital.

Two days later Riffat Ali, brother of deceased Syed Asghar Ali identified the body. The police during interrogation recorded statement of Bahawal Khan, who disclosed that Talib, Ashiq, Altaf and present applicant Inayat are involved in the murder of Asghar Ali.

When the bail plea came up, counsel for applicant/accused said the applicant is innocent and was falsely implicated in the case. The accused were named/ nominated in the case after considerable delay, submitted the applicant's counsel. The bench, however, after hearing the state counsel and pursuing the record of the case dismissed the bail application.

NOTICES TO PCG: A division bench of Sindh High Court, comprising Justice Anwar Zaheer Jamali and Justice Gulzar Ahmed, on Thursday issued notice to Pakistan Coast Guard and others on a petition seeking release of a vehicle.

Mohammad Khan stated that his Toyota Corolla car AC-3156, which he had purchased after due verification and completion of formalities, was taken into custody by the official of PCG at civil airport Karachi on Oct 7, 2003, without any reason. The court was prayed to direct respondent to release the vehicle lying in its custody.

AAG DIRECTED: The Sindh High Court on Thursday directed the additional advocate general Sindh to make a definite statement as to what departmental action had been taken against the suspended police officials of the Sachal police.

The SHC bench, comprising Justice Anwar Zaheer Jamali and Justice Gulzar Ahmed, was hearing the petition of Raza Khan against kidnapping of his brother Gul Farooq by the police officials.

The petitioner alleged that DSP Ghulam Mustafa Shah and SI Mohammad Sarfaraz (now suspended) took his brother unlawfully. The court, on last hearing, ordered AAG Abbas Ali to produce the suspended police officials before the court.

The court adjourned the hearing till July 15 on the request of provincial attorney and directed them to file a statement after taking instructions from concerned quarters as to what further departmental action had been taken against the suspended police officials.
