LAHORE, March 31: The consumer court has ordered a company to replace a faulty generator or return its Rs200,000 price along with Rs15,000 maintenance charges and Rs10,000 litigation cost.

Petitioner Mohammad Bashir Ahmad said he had purchased a 9.5KVA diesel generator for Rs200,000 from Enpower, Engineering and Services with an annual maintenance contract of Rs15,000 on Jan 12, 2007.

The petitioner said he made several verbal and written complaints to the company after the generator failed to operate either manually or automatically upon its installation.

He said on June 28, 2007, he finally asked the company to return the money along with the maintenance amount, and also sent a legal notice in this regard. When the company did not reply to the notice, the petitioner moved the consumer court and sought Rs940,000 as damages from the respondent.

“It has been proved that the company provided a faulty generator to the petitioner,” the court said.

The court directed the company to replace the generator of the same specification, capacity and model with a brand new one within 10 days from the date of this order.

The court also ordered the company to pay Rs10,000 litigation cost to the petitioner and provide free maintenance for six months after replacement. In case, the respondent failed to replace the generator within 10 days, he shall refund the purchase amount of Rs200,000, maintenance charges worth Rs15,000 and Rs10,000 litigation cost to the petitioner within 20 days from the date of this order. —Reporting
