PESHAWAR, July 30: A court on Monday dismissed the bail petition filed by the son of an MPA of the Muttahida Majlis-i-Amal and his friend who were arrested on charges of carrying liquor and fake currency notes.
Judicial magistrate Ahsanul Haq said the accused were not entitled to a bail.
The two accused — Samiullah Khan, the son of MPA Abdul Razzak Mujaddadi, and Abdul Haq — were arrested at the Hayatabad check post on July 26.
An FIR was registered at the Hayatabad Police Station against them under Section 489(B) of the Pakistan Penal Code, dealing with fake currency notes, and Section 4 of the Prohibition (Enforcement of Hudood) Order, 1979.
President of the Peshawar District Bar Association Maulana Shamsul Haq appeared for the petitioners and contended that they had been falsely implicated in the case, adding that there was no independent witness to testify that the items in question were recovered from the two petitioners’ possession.
He argued that the police had prepared a concocted case against the petitioners and that the offences were bailable. Hence the petitioners were entitled to a bail.
The state prosecution contended that some liquor and fake currency notes had been recovered from the accused and that they had been caught red-handed.
The police claimed that initially the MPA’s son — who belongs to Bannu, the chief minister’s native town — did not give his right name to the police. The accused also tried to influence the police.
Officials claimed that soon after the registration of the FIR, the police station started receiving telephone calls from influential people, asking them to release the two accused.
