RAWALPINDI, March 7: Additional district and sessions judge Malik Mohammad Iqbal here on Monday ordered the SHO of Airport police to register an FIR against a serving army colonel who allegedly attempted to take possession of a house helping his associates in violation of the court orders.
The petition was filed by Rashid Attique Qureshi, the attorney of the house owners, for registration of a case against Ghazala Habib, an employee of Radio Pakistan, and Col Ahmer Haleem of the army. The petitioner alleged that the accused had forcibly taken possession of the house at Gulraiz-III near Morgah and the police had refused to register a case against them.
According to the petitioner, Naila and her husband Azhar Aslam had been living in one portion of their house and rented out the other portion.
The dispute erupted when the mother and a brother of Mr Azhar along with his sister-in-law Ghazala Habib tried to occupy the house. The owners filed a civil suit and obtained possession status quo on November 16, 2006. However, the other party also moved the court and a legal battle ensued.
While the case was pending in the court, the owners of the house left for the Philippines after giving general power of attorney of the house to Mr Rashid Qureshi. Soon after, the claimants to the house approached the tenant and tried to occupy the vacant portion.
On this, the owners asked the tenant to vacate the house but he refused on the insistence of Ghazala Habib. As a result, Mr Rashid again filed a petition in the court to get possession of the house which was decreed in his favour and the house was handed over to him through a bailiff on February 24.
On the same day, Ghazala Habib and Col Ahmer along with some armed men reached the house and allegedly threatened Mr Rashid Qureshi of dire consequences if the house was not vacated. The petitioner alleged that the army officer also called the police to take possession of the house in violation of the court orders.
