LAHORE, Nov 13: Justice Sheikh Azmat Saeed of the Lahore High Court on Monday issued fresh notices in a petition seeking shifting of the cattle market and slaughter house from the vicinity of Sabzazar Housing Scheme to some place outside the city.

The court issued notices to the Punjab government, district nazim Mian Amer Mahmood and Allama Iqbal Town nazim Sardar Kamil Umar in a writ petition and a contempt of court plea filed by Sabzazar Welfare Society president Saeed Aasi who submitted that the slaughter house and cattle market had encroached the housing scheme exposing residents to various contagious diseases.

The court directed the legal adviser of Allama Iqbal Town to ensure that the town nazim submitted his reply before the petitions were taken up again in the last week of this month.

Petitioner’s counsel Kamran Sheikh submitted that the petition had been filed about two years ago and the town administration was yet to take steps to remove the slaughter house and cattle market.

DISMISSED: A full bench of the Supreme Court on Monday dismissed for non-prosecution an appeal filed by Misri Shah ex-SHO Riaz Ali Shah against orders of the LHC which directed police authorities to take legal action against him for involving a citizen and his relatives in false cases.

The LHC while accepting the petition of a Misri Shah resident, Muhammad Razzaq, ordered the Lahore city SP to initiate legal action against the SHO and other policemen who were responsible for fabricating the cases.

Mohammad Razzaq had, in his petition, alleged that the SHO had conducted an illegal raid at his house on Oct 9, 2003 on the charges that a proclaimed offender was present there. The SHO, he stated, arrested his five relatives and registered four different cases against them under Arms Ordinance.

Inspector Shah moved the apex court against the LHC orders stating that he had acted according to law and no false case was registered against any one. He prayed the court to set aside the LHC orders.
