PESHAWAR, Nov 4: A private security guard charged with attempting to molest a US national was acquitted by an Additional District and Sessions judge Gohar Rehman Khan here on Friday.
The court accepted an application filed by the accused, Hussain Ghulam.
The victim, Ms Rebecca, who was a volunteer with the International Rescue Committee, has entered into a compromise with the accused and since then she has not been pursuing her case.
The lady was complainant in an FIR registered at University Town police station on Dec 18, 2005, wherein she had charged the guard of outraging her modesty, attempted rape and injuring her.
Despite repeated court notices the complainant and other prosecution witnesses failed to turn up before the trial court. During some of the previous hearings the court issued non- bailable arrest warrants of Ms Rebecca and other witnesses, but those warrants could not be executed as she was not in the country.
Finally, the police concerned produced a statement written by the lady. She stated that the matter of the incident with Hussain Ghulam is no longer of her concern. She stated that this case was now finished for her.
After her statement the accused, who was on bail, moved an application under section 265-K requesting the court to acquit him before conclusion of the trial.
The accused stated that a compromise had already taken place between him and the complainant and she had forgiven him. He added that none of the witnesses had turned up before the court despite repeated notices.
The accused has placed on record a compromise deed which took place between him and the complainant. In that deed the lady stated that on request of some elders she had pardoned the accused. On this the accused was also granted bail by an additional district and sessions judge on Jan 24, 2006.
The complainant had originally alleged that on Dec 18, 2005, after she came out of the bathroom, the accused made an attempt to rape her. Later, he begged forgiveness, but she informed her colleagues and the accused was arrested by the police.
