KARACHI, Oct 1: A single bench of the High Court of Sindh comprising Justice Khilji Arif Hussain disposed of a stay application filed by a city transporter, Rana Muneer Ahmed, in a suit against KASB Bank.
In the suit stay was sought against snatching/halting and/or disturbing the possession of 25 UTS buses' fleet plying on the Urban Transport Service route-11.
After hearing the advocates representing both parties, the court ordered with their consent that the official assignee be appointed as receiver of the 25 UTS buses, which are the subject matter of the suit.
The plaintiff will continue to operate the buses as he is at present operating, but under the supervision of the official assignee or his nominee.
The plaintiff will submit fortnightly account(s) with the official assignee and will deposit 50 per cent with the official assignee, which can be adjusted towards the liability of the defendant/bank.
Advocate Saalim Salam Ansari along with Advocate Mukhtar Ahmed Kuber appeared for the plaintiff/borrower while Advocate Nadeem Ahmed represented the defendant/bank.—APP
