PESHAWAR, Sept 8: A local court on Friday ordered registration of an FIR against a union council nazim, naib nazim and secretary charged with preparing forged resignations of three councillors for countering a no-trust move.
The court of additional district and sessions judge, Jamaluddin Khan, accepted a petition filed by three councillors of union council Landi Arbab.
The petition was filed by Meraj Bibi and two other councillors under section 22-A of the Criminal Procedure Code which extends power of justice of peace to the court.
The petitioners had requested the court to order registration of an FIR against Nazim Asifullah Qasmi, Naib Nazim Ashfaq Khan and the secretary of the council.
Advocate Bashir Khan Tangi appeared for the petitioners and argued that the councillors in the union council had moved a motion of no-confidence against the nazim. He added that to frustrate that move the nazim, naib nazim and secretary of the council prepared forged resignations of the three councillors.
Mr Tangi stated that the petitioners had approached police for registration of the case but they refused to register the same. He added that left with no other option they approached the court for registration of the case. He requested the court to accept the petition and order registration of an FIR under section 419, 420 and 468 of Pakistan Penal Code.
Meanwhile, a two-member bench of the Peshawar High Court on Friday admitted to full hearing a writ petition filed by the union council nazim, Asifullah Qasmi.
The bench comprising Justice Saleem Khan and Justice Hamid Farooq Durrani issued notices to the respondents including the election commission of Pakistan, the Peshawar district coordination officer and councillors of the council.
The petitioner has requested the court to direct the election commission for issuance of a notification regarding failure of a no-confidence motion against him on Sept 1. He further stated that the election commission should be restrained from convening any fresh session for deciding any other no-confidence move against him.
The petitioner claimed that some councillors had moved a no- trust motion against him which was defeated in the session on Sept 1.
