HYDERABAD, June 29: The Sindh High Court, Hyderabad circuit bench, here on Thursday issued notices to EDO revenue Abdul Sattar Jatto, Mohammad Shahid, the district officer revenue and SHO Cantonment police station Javed Khanzada, on a contempt of court application in Dialdas club case for July 5.
The contempt application was filed by Aijaz Ali Khoja, the caterer of the club whose constitutional petition was also fixed for hearing on the same date. In his present application, Mr Khoja maintained that on June 21 the court ordered status quo in the petition while issuing pre-admission notices to respondents whose counsel sought time to file power on behalf of his clients.
He said that grievance of the petitioner in the matter was that respondents i.e. Zila Nazim, DCO, EDO and district officer revenue, Hyderabad, were harassing the petitioner through their officers and wanted to dispossess him from the club without lawful authority.
He maintained that petitioner had executed agreement with honorary secretary of the club in March 2004 and said agreement will expire in March 2009 and added that petitioner had not trespassed or encroached as he possessed validly executed agreement which empowered him to decorate tennis court and auditorium for arranging marriages.
In return, he said, the petitioner was to pay Rs 100,000 to the club in addition to a huge amount of over Rs2.2 million at the time of agreement’s execution after completing formalities.
He said that after this court ordered the parties to maintain status quo and the respondents were violating it thus committing contempt of court.
