KARACHI: The Sindh High Court on Tuesday dismissed a petition challenging the eligibility of the governor of Sindh to hold the top office of the province after the petitioner did not press it.
Citing the secretary of cabinet division, governor of Sindh through his secretariat, chief secretary and others as respondents, petitioner Bux Ali Pirzado along with another petitioned the SHC and stated that Governor Karman Tessori had become ineligible to hold such office.
The petitioners also submitted that the office of the governor was purely a non-political position, but Mr Tessori had engaged himself in political activities during his tenure, which has caused division and hatred among the people of Sindh.
Therefore, they further argued that the incumbent governor could not hold such a prime position as he had become ineligible to stay on such a post under Article 101(2) of the Constitution.
At the last hearing, the SHC said that subject to maintainability of the petition, it was issuing notices to the respondents as well as federal and provincial law officers.
At the outset of hearing on Tuesday, a two-judge constitutional bench of the SHC headed by Justice Muhammad Saleem Jessar confronted the lawyer for the petitioners as to the maintainability of the petition.
However, the counsel did not press the petition anymore and accordingly, the bench dismissed the same.
