Plea for judicial inquiry filed: Death at factory
HARIPUR, May 27: An amended petition seeking a judicial inquiry, arrest of the director (administration) of the Dewan Salman Fibers, Hattar, and seven co-accused in the alleged murder of a junior supervisor was filed with the district and sessions judge here on Friday.
The court will announce its verdict on June 1.
One Talat Habib Babar, a junior supervisor of Dewan Salman Fibers, Hattar, died after falling from a 95-ft high factory building on March 15. The factory administration termed it suicide, while his father lodged an FIR against director Raja Wilayat and seven other employees of the factory for killing his son.
Forming of a union in the factory was said to be a cause which led to his death.
Habibullah Saadi, the father of Talat Habib Babar, had filed an amended constitutional petition under section 22-A (6) of the Criminal Procedure Code (CrPc) with the court of District and Sessions Judge Jehangir Khan against the cancellation of his FIR, which he had lodged with the Hattar police station on March 20 accusing Mr Wilayat, Malik Safdar, Tariq Mehmood, Imran Hussain, Arshad Mehmood, Mohammad Sharif, Rukhsar Hussain and Mohammad Wasim for allegedly killing his son.
Investigation of the case was entrusted to Deputy Superintendent of Police (Investigation), Peshawar, Ghulam Mohammad who in his report termed it a suicide case.
The Haripur police cancelled the FIR under section 173 CrPC and submitted the report before the court of Additional Sessions Court III, Haripur, from where all the seven accused, except Raja Wilayat, had already obtained bail before arrest till May 6. The police also filed a case against the petitioner under section 182 of the CrPc for wrongly implicating eight people in the murder case.
Advocate Shabbir, who appeared on behalf of the petitioner, in his arguments pointed out certain flaws in the investigation. He said that according to autopsy report of the deceased, the bones of his right thigh, left arm and skull were broken, while his left ear was amputated and face and nose carried multiple wounds, which suggested that he was murdered and had not committed suicide.
He argued that the doctor of Kot Najibullah hospital was forced to frame the medical report after visiting the place where the incident was occurred. He told the court that the history of medico-legal cases was devoid of such precedence that a medical officer prepared an autopsy report at the spot of occurrence.
The petitioner prayed for the constitution of a medical board for opinion on the nature of injuries, inquiry of the case by a judicial officer and arrest of Mr Wilayat and other co-accused.
The court has fixed June 1 for decision on the petition.
GOHAR AYUB: Former foreign minister and senior vice-president of the PML Gohar Ayub Khan has denied reports that he was among the contestants for the office of party president.
Talking to Dawn on telephone from his Islamabad office, he said he was bound to follow party discipline and rules and had full confidence in the leadership of PML chief Chaudhry Shujaat Hussain.
He said he would prefer to support Chaudhry Shujaat for the top slot of the party during the next party election.
