Apex court reinstates PML-N MPA

ISLAMABAD, March 6: The Supreme Court on Monday restored Malik Mohammad Imran Khan of the PML-N as member of the NWFP after admitting his appeal against disqualification.

A bench, comprising Justice Sardar Mohammad Raza Khan and Justice Falak Sher, while admitting the election appeal of Malik Imran, also summoned the record of an anti-corruption’s inquiry committee that earlier had declared the degree of the MPA as fake.

The court also directed the Election Commission to withdraw its earlier notification of holding provincial election on March 16 to fill the seat.

Malik Mohammad Imran Khan, PML-N candidate from Lukki Marwat, had won the general election by defeating Saleem Saifullah Khan of the PML-Q.

However, after a year, Saleem Saifullah challenged the graduation degree of Malik Imran.

Later, the Sindh anti-corruption department of the Karachi University constituted a committee to probe into the matter and the body declared the degree fake.

Later, Malik Imran filed a writ in the Sindh High Court (SHC), where the case is still pending.

Meanwhile, the MPA challenged the decision of the anti-corruption committee in the Peshawar High Court, which also upheld the decision of the committee. Subsequently, he challenged the PHC order before the apex court, which restored him as MPA from the NWFP.

Senior lawyer Malik Mohammad Qayyum represented Malik Imran, while advocate Sardar Khan appeared on behalf of Saleem Saifullah.
