KARACHI, Sept 29: The Sindh High Court asked a builder on Thursday to demolish all illegal construction on his plot and on the land encroached by him in the PECHS within 30 days, failing which the Karachi Building Control Authority would take appropriate action at his cost.

Disposing of an appeal moved by builder and developer Bashiruddin Qureshi against a single judge’s order, a division bench, comprising Justices Mushir Alam and Syed Zawwar Hussain Jaffery, ordered that all violative structures on plot number 51-H-1, Block 6, Pakistan Employees Co-operative Housing Society, and the adjoining illegally-occupied land pinpointed in the SHC nazir’s report should be removed by the appellant.

Contesting the appeal earlier, KBCA counsel Shahid Jamil Khan said that as pointed out in the nazir’s report, the appellant had expanded his plot, which initially measured 237 square yards, into a 1200-square-yard plot and raised unauthorized construction all over. He moved two constitutional petitions and a suit, which were all dismissed by the high court.

NOTICE TO AG: The court, meanwhile, issued the advocate-general a notice for Oct 10 in a KBCA application seeking a direction to the police department to stop immediately construction of a police post on Shahrah-i-Quaideen near the PECHS graveyard.

The application said police officials were constructing the post in clear violation of rules and regulations. They arrested the members of the KBCA squad when they tried to demolish the site. They trained their guns on the chief controller of buildings, Brig (retd) A.S. Nasir, when he visited the site, the application said. It sought directions to the Sindh government and the provincial ombudsman to effectively intervene in the matter.

detention case: A division bench of High Court of Sindh (SHC), comprising Justice Ghulam Rabbani and Justice Azizullah M Memon, on Thursday directed the District and Sessions Judge, Thatta, to recover two alleged detainees through a judicial magistrate, add agencies.

The orders came during the hearing of a constitutional petition filed by one Shafique Karnani who alleged that his brother Iqbal Karnani and a nephew were picked up by police in murder case of one Dil Murad.

The counsel for petitioner maintained that so far none of them has been produced before a court for obtaining remand. They are in illegal custody, he said, requesting the court to order recovery of the detainees. The bench after hearing the counsel directed the DJ Thatta to appoint a judicial magistrate for conducting raids to recover the alleged detainees.

The bench also sought a report on Friday from DJ, Thatta.
