PESHAWAR, Aug 6: The Peshawar district and sessions judge, Shahjehan Khan Akhundzada, on Saturday summoned a station house officer (SHO) charged by a man of keeping him in illegal confinement and registering a fabricated case against him.

The applicant, Niaz Gul, son of Salahuddin, claimed that his wife fell seriously ill during his absence and she expired two days before his release.

The court ordered that the SHO of Mathani police station, Zulfiqar Khan, who was at that time serving as SHO Bana Mari police station, should appear in person on August 9.

The applicant stated that on the morning of March 23, 2005, SHO Zulfiqar Khan along with a police party raided his residence at the Scheme Chowk, Kohat Road, and arrested him.

He stated that no woman police officer accompanied the raiding team and they violated the sanctity of his home.

Mr Gul stated that he continued to ask the grounds for his arrest but he was told nothing.

He said that he was blindfolded and kept in illegal detention for 10 days after which he was shifted to the Hayatabad police station. Later, he was shifted to the Bana Mari police station.

He alleged that he was charged with carrying explosives and arms and was declared a terrorist by the SHO concerned. He added that newsmen were invited and he was photographed with the explosives.

The applicant claimed that he was taken to the anti-terrorism court where he narrated his story to the judge who refused to hand him over to the police.

He added that the anti-terrorism court transferred his case to a normal court.

He stated that he filed a bail petition before the court concerned but the police had not been producing his case record due to which his application continued to linger for three months. Finally, he was granted bail on August 3.

Mr Gul stated that after his release he went to the residence of his sister. He added that his sister told him that due to his arrest his wife had fallen ill and had died on August 1.

The applicant said that he has a 13-month-old daughter.

He requested the district and sessions judge to take appropriate action against the SHO concerned so that in future no police officer would be able to act in such an arbitrary manner.
