LAHORE, Aug 3: Holding that cases against an accused facing charges of illegal detention could not be quashed, the Supreme Court on Wednesday ordered restoration of the FIR against an accused who was facing the allegation of illegally detaining people.
Comprising Justice Khalilur Rehman Ramday and Justice Syed Tasaddaq Husain Jilani, the court directed Lahore police chief Tariq Saleem to personally investigate the events which led to the registration of a case against Lower Mall police SI Nawaz Cheema who has approached the Supreme Court in a leave to appeal against a LHC decision.
The sub-inspector challenged the LHC decision through which three FIRs against Mohammad Lateef of the same area, facing charges of unlawfully detaining some people, were quashed.
He submitted in the leave to appeal petition that the LHC also got a criminal case registered against him on the ground that he had planted arms on Lateef while registering three cases against him.
