KARACHI, July 28: An anti-terrorism court dismissed on Thursday a direct complaint against Ms Shahnzaz Hamid, a complainant in the murder case of her husband Shahid Hamid, for the offence of alleged perjury.
The complaint was filed under Sections 476, 193, 194 and 195 of the Pakistan Penal Code by Nawab Mirza on behalf of Saulat Ali Khan, who was sentenced to death in the Shahid Hamid murder case by an anti-terrorism court on May 24, 1999.
Judge Arshad Noor Khan of the ATC-3 observed in his order that the application was not maintainable as the matter had already been decided by the Supreme Court in the review application.
The judge further remarked that the matter was already dealt by the Supreme Court, therefore, this court had no jurisdiction to entertain any application after attaining the finality.
The plea of the counsel for Saulat Khan was that Ms Shahnaz Hamid made two different inconsistent and contradictory statements, one before the trial court and the other in form of an application to the SHO.
The judge also observed that the certified copy of the statement which was produced with the application was not produced before the court.
CONVOY ATTACK CASE: An anti-terrorism court put off on Monday the hearing of the corps commander’s convoy attack case against 11 workers of the banned Jundullah group after recording the statements of two prosecution witnesses.
Judge Feroze Mehmood Bhatti fixed July 30 for the next hearing after the statements of Dr Syed Atif Mehmood and Dr Ghulam Rasool Tariq of the PNS hospital, who had treated five injured victims of the attack.
Defence counsel M. R. Syed and Mushtaq Ahmed also cross-examined the prosecution witness.
The prosecution, represented by Iqtidar Ali Hashmi and Maula Bux Bhatti, has, so far, examined 13 prosecution witnesses.
Ataur Rehman alias Ibrahim, Shahzad Ahmed Bajwah, Yaqoob Saeed, Uzair Ahmed, Shoiab Siddiqui, Danish Inam, Najeebullah, Khurrum Saifullah, Shahzad Mukhtar, Khalid Rao and Adnan Shah alias Tipu have been charged with a series of offences, including attack on the motorcade of Lt-Gen Ahsan Saleem Hayat on June 10 last year on the old Clifton bridge, which resulted in the death of six army personnel, three policemen and a passerby.
Mohammed Qasim, Maaz, Shahab, Bilal, Tayyeb, Hammad and Fasih have been declared absconders.
VAN ATTACK CASE: The same court adjourned the hearing of the Rangers van attack case against two workers of the banned Jundullah group after recording the statements of two prosecution witnesses.
Ataur Rehman and Shahzad Ahmed Bajwa have been charged with attacking the ranger’s mobile van near the Baloch Colony bridge on March 19, 2004. Judge Feroz Mehmood Bhatti of the ATC-2 fixed August 2 for the next hearing after the statements of Syed Mohammad Raza and Sub Inspector Minthar Ali of the Gulshan-i-Iqbal police.
Syed Mohammad Raza stated that he had informed the police on March 19, 2004 about the presence of a white Margalla car parked in a suspicious manner at the Block-5 of Gulshan-i-Iqbal. PW Minthar Ali deposed that he took the custody of the vehicle.
Defence counsel M. R. Syed also cross-examined the two prosecution witnesses.
