HYDERABAD: SHC seeks accident case papers

HYDERABAD, Dec 5: A division bench of the Sindh High Court, Hyderabad circuit bench, on Thursday directed the additional advocate general, Sindh, Masood A. Noorani, to obtain police papers and call the investigating officer of a case pertaining to the killing of six people in an accident within the limits of Lunikot.

Mr Noorani sought time to obtain police papers and call the investigating officer.

The court passed the order on a constitutional petition, filed by a scavenger, Kang Bheel, against the DPO, Dadu, and the SHO, Lunikot police station.

He said that he had been residing in Hussainabad and collected waste papers and other discarded items from different areas.

He said that they were at a hotel 32 miles away from Hyderabad and after having their meal they went for resting on a ground.

He said that at 1am an oil tanker (LSB-9969) crushed six people to death. On hearing their cries, the people present there ran towards them.

He said that he saw the driver of the tanker fleeing while abandoning his vehicle, which was later impounded by the police.

He said that he had narrated the facts to the SHO of the police station who obtained his thumb impression without reading out the contents of the FIR.

He added that to his utter shock he came to know at the time of submission of the charge-sheet that the SHO did not incorporate the contents in the FIR as narrated by him as he (i.e. the SHO) did not apply the relevant sections of the PPC.

He told the court that the investigating officer had damaged the petitioner’s case.

He prayed the court to direct the SHO, Lunikot police station, to lodge a second FIR according to the relevant facts and honestly investigate the case.
