HYDERABAD: Inquiry officer appointed

HYDERABAD, Nov 10: The Sindh High Court, Hyderabad circuit bench, on Monday appointed a sessions judge as an inquiry officer to ascertain facts of a constitutional petition, seeking registration of a case against Hyderabad DPO, Makki Shah SHO and a private respondent.

The order was passed by Justice Mohammad Musa K. Leghari on a petition filed by one Amir Ali Sayani.

He said he obtained a shop in the Al-Amna Complex on rent from Dr Naeem Ahmed and had paid a security deposit of Rs200,000.

He said two months back the landlord asked him to vacate the shop as he intended to give it to another shopkeeper.

The petitioner sought time as well as a security deposit to vacate the shop which annoyed the landlord.

On the request of the landlord, the DPO asked the respondent SHO to get the shop vacated.

On Aug 17, the SHO threatened the petitioner of implication in a case and on Sept 4 registered a case. He said after his arrest he was shifted to the Hatri police station and was maltreated the whole night as a result of which three of his teeth were broken.

He said during his custody the respondent, Dr Naeem Ahmed, got the shop vacated forcibly after having the shop’s lock broken.

He said that after his release police again tried to arrest him in some other case with ulterior motives so that he could not make any complaints against anyone.

He prayed to the court to order restoration of possession of his shop; declare the act of respondent police officials, holding him in wrongful confinement and dispossessing him of his shop as illegal and registration of a criminal case against the respondents, including the SHO, Makki Shah, and the DPO, Hyderabad.
