PESHAWAR, Oct 27: An anti-terrorism court here on Monday acquitted a person accused of killing a policeman and injuring another one.

The court presided over by Akhter Zareef Khan observed that the prosecution could not prove its case against the accused, Jawed Khan.

The accused Jawed was tried on charges of killing a constable, Jawaid Khan, and injuring another constable, Pervaiz.

The constable was killed on Feb 11, 2003, at Paloosi area in the jurisdiction of police station University Town. They were on a routine duty when some unknown persons fired at them. Later on, the police arrested two men — Saifur Rehman and Noor Hayat.

The two accused were earlier tried by the ATC and were acquitted recently. The third accused, Jawed, was absconding and was arrested a few months back.

The defence counsel contended before the court that the injured constable, Pervaiz had not recognised any of the accused in the identification parade. He contended that Pervaiz had claimed that as the incident happened during night, so it was not possible to recognise the attackers properly.

The counsel contended that there was no evidence against the accused and he was named by the earlier two accused who had already been acquitted by the court. He added that he had not confessed the crime, therefore it was a case of no-evidence.
