PESHAWAR, Sept 5: Additional District and Sessions Judge Shehbar Khan on Friday awarded capital punishment to a person for killing his brother-in-law and also fined him Rs40,000.

The court also sentenced him to undergo three-year rigorous imprisonment and fined him Rs3,000 for injuring the son of his brother-in-law.

The convict, Mohammad Zaman, had killed his brother-in-law, Faqir Gul, and injured his son, Hazrat Bilal, on Sept 11, 1994, at Babu Garhi.

An FIR was registered against him by the wife of Faqir Gul at Mathra police station.

The motive behind the murder was stated to be a domestic dispute.

The additional public prosecutor, Saleem Khan, appearing for the State, contended before the court that the accused was directly charged in the FIR.

He stated that according to eyewitnesses including his father-in-law, the accused had committed the offence.

Mr Khan argued that after the occurrence the accused was absconding for about six years, which further proved his involvement in the crime.

He pointed out that the accused was arrested from tribal area and then handed over to the police.

BAIL GRANTED: The Peshawar High Court on Friday allowed bail to a person accused of carrying liquor.

A single bench, comprising Justice Shehzad Akber Khan, directed that the accused, Mian Gulbahar, should be released after furnishing two sureties of Rs1,00,000 each.

Earlier, Swat Zila Qazi (district and sessions judge) had turned down his bail application.

The accused was arrested on June 14 for allegedly carrying 15 litres of liquor. He was charged under section 3/4 of the Prohibition (Enforcement of Hudood) Order, 1979.

Advocate Yousaf Khan Yousafzai appeared for the applicant and argued that the applicant was falsely implicated in the case.

He added that bail could be allowed in such like cases and cited various judgments of the superior courts in support of his contention.
