KARACHI, July 17: A petition has been filed in the Sindh High Court by a woman against the detention of her husband allegedly by the law-enforcement agencies.
While making the deputy director of FIA, assistant director of FIA and the Airport Police as respondents, Ms Farhat Paracha prayed that the officials be directed to produce the detainee before the court.
Petitioner’s counsel Khawaja Naveed submitted on behalf of Ms Paracha that her husband, Saifullah Paracha, a businessman, proceeded to Bangkok on July 5 from Karachi, but did not reach there.
The businessman had earlier phoned his daughter and stated that all formalities had been completed and he was about to board the aeroplane.
The petitioner further stated that she contacted the interior ministry, the Thai Consulate in Karachi, but all her efforts proved in vain.
She submitted press reports of July 11 pertaining to the arrest of Mr Paracha by the law-enforcement agencies.
The petitioner further submitted that neither the police showed his arrest, nor produced him before any court in Karachi.
PRISONER’S TRANSFER: A division bench of Sindh High Court, comprising Justice S Ahmed Sarwana and Justice Zia Pervez, on Thursday disposed of a petition filed by Ms Shamim Akhtar and directed the jail authorities to shift the prisoner from Sukkur to Karachi jail.
The petitioner moved the SHC against transferring her son Jehanzeb alias Shadab, an activist of Mohajir Quami Movement-Haqiqi from Karachi to Sukkur jail. He was arrested by the Malir police on Oct 24, 2002, in an arms case and later implicated in 12 other criminal cases.
She stated that when she went to jail to meet Shadab on July 25, she was informed that he had been transferred to Sukkur Jail.
She submitted that cases against him are pending in Karachi and expressed the apprehension that he might not be produced before the court which is an abuse of the process of law.
Jail Superintendent Rashid Saeed filed a written statement before the court, stating that the prisoner was shifted on June 26, to Sukkur jail with the permission of IG Prisons as prisoners of both the MQMs were lodged in the central jail and it was not beyond expectations that an untoward situation takes place.
State counsel stated that he had no-objection on the transfer of prisoner.
After statement of the state counsel, the court ordered the shifting of the prisoner from Sukkur to Karachi jail and disposed of the petition.
Ali Gohar Masroof, advocate, appeared for the petitioner, while Additional Advocate General Salman Habibullah represented state.
WARRANTS ISSUED: Bailable warrants of arrest were issued against SI Ghulam Mohammed of Karachi city police here on Thursday by a division bench of High Court of Sindh, comprising Justice S. A. Sarwana and Justice Zia Pervez.
The bench was hearing a constitutional petition filed by Samia Naz, younger sister of detenue, Mohammed Naeem.
Naeem was earlier recovered by the Nazir of the court, Mr Moinuddin, from CID Napier. The Nazir got him released according to the orders of the Sindh High Court as he was not booked in any case and was detained for interrogation.
When the matter came up for hearing, SI Ghulam Muhammed was called absent. The bench noted that he remained evasive also on July 10 and failed consecutively to inform the court about the reasons for detaining Naeem.
The bench then issuing bailable warrants of arrest of SI for Rs 50,000 put off further hearing till July 23.—APP/PPI
