LAHORE, June 30: Justice Munir A. Sheikh of the Supreme Court on Monday turned down the Bar request to reject the three-year extension in his superannuation age under the Legal Framework Order, falling due to him from July 2 (tomorrow).
Supreme Court Bar Association president Hamid Khan, Pakistan Bar Council’s executive committee chairman Kazim Khan and Lahore High Court Bar Association president Hafiz Abdul Rehman Ansari personally presented a letter to Justice Sheikh currently sitting at the Lahore registry on behalf of the legal fraternity to refuse the extension.
“It is disappointing for us to hear that the judge is going to avail the extension,” Hamid Khan said after the conclusion of his meeting. The bar members are likely to reveal the details of their meeting later on.
On Tuesday (today) Justice Munir turns 65, which, according to the previous law —existing before the promulgation of an LFO provision in January 2002 envisaging three-year extension in the respective retirement ages of superior court judges — was the retirement age for a Supreme Court judge.
In case Justice Sheikh holds his office by July 2 and afterwards, he would be the sixth judge in the sitting judiciary to avail the three-year extension after — Chief Justice of Pakistan Sheikh Ahmad Riaz, Justice Qazi Muhammad Farooq of the Supreme Court, Justice Raja Muhammad Sabir of the Lahore High Court, Justice Ashraf Leghari of the Sindh High Court, Justice Abdur Rauf of the Peshawar High Court.
Justice Sheikh was appointed as the additional judge of the LHC on March 11, 1987 and was confirmed during 1989 as the LHC judge before his elevation to the SC during 1997.
