PESHAWAR, June 15: A trial court has acquitted two persons in a robbery case after it came to know that three dead persons were charged by the police in the same case.

The court of additional district and sessions judge, Sardar Mohammad Irshad Khan, acquitted two applicants, Aamir and Abdul Hanan under section 265-K of the Criminal Procedure Code on Saturday when the trial against them was in the initial stages. Both the accused claimed innocence, stating that the case was cooked up.

Their counsel, Noor Alam Khan, pointed out to the court that the two persons were falsely implicated in the instant case. He stated that three of the accused persons mentioned in the FIR had died during different police encounters much before the occurrence had taken place.

Moreover, he informed the court that one of the accused, Abdul Hanan, had been in prison for the last more than a year and at the time of occurrence he was still in prison, therefore he got nothing to do with the said offence. He added that in fact the occurrence had not taken place and the police was settling personal scores with the accused, Aamir.

The accused Aamir was arrested in December by the officials of Pishtakhara police station. Initially, the police claimed of recovering a pistol from him. Later on, a person named Ghazi Khan, registered an FIR on Jan 16 under section 17(3) of the Offence Against property (Enforcement of Hudood) Ordinance, 1979.

The complainant stated that a few months back a dacoity had taken place at their residence. He claimed that he continued to search for the dacoits and finally he came to know that the dacoity was committed by Aamir, Abdul Hanan, Sabir, Ittefaq and Khan Jee.
