HYDERABAD, May 23: A division bench of the Sindh High Court, Hyderabad, the other day directed the Sindh chief minister to resolve the dispute over recovery of market fee between the Market Committee, Hyderabad, and the Latifabad taluka Nazim.

The order was passed after the additional advocate-general of Sindh, Masood A. Noorani, told the court that such a dispute was to be resolved in line with the Sindh Government Rules of Business, 1986.

The state counsel said in such circumstances and disputes, the minister of the department concerned had to present a summary before the chief minister for resolving the issue.

He said the Sindh Local Bodies minister had submitted a summary before the chief minister. He also brought on the record a copy of the summary provided to him by the Latifabad Taluka Council in connection with the cattle pen contract.

He pointed out that it was up to the Sindh minister for agriculture to present a summary to the chief minister to resolve the issue.

The court ordered that the petitioner should ensure that the summary was moved to the chief minister who would resolve the dispute by the end of current financial year.

The Market Committee had filed the petition, challenging the recovery of market fee.

The petitioner said before the promulgation of the Sindh Local Government Ordinance, 2001, the defunct Hyderabad Municipal Committee neither intervened nor objected to the recovery of the fee by the Market Committee. But after the promulgation of the ordinance, the Nazim of the Latifabad taluka had been claiming that the taluka council was entitled to recover the fee.
