KARACHI, July 30: The state was put on notice on Tuesday for Aug 3 on an application moved by Mohammed Sharif, father of accused Mohammed Ashraf who was booked in US Consulate suicide bombing case and attempt to assassinate General Pervez Musharraf.

Raza Ali Abidi, counsel for accused, representing the applicant submitted that the accused is not well and needs medical treatment which was denied to him. He requested the court to direct the jail authorities to arrange medical treatment of the accused.

The applicant also sought a meeting of family with the accused Mohammed Ashraf.

Justice Shabbir Ahmed of High Court of Sindh (SHC), Administrative Judge of Anti Terrorism Courts (ATC’s), after hearing the counsel issued notice to state for Aug 3. Another division bench of SHC, comprising Justice Ata-ur-Rahman and Justice Muhammed Afzal Soomro, disposed of a constitutional petition filed by one Zahoor Ahmed, a cattle-pen owner while directing the Town Police Officer (TPO) Korangi to record statement of petitioner and to register an FIR if cognizable offence is made out against officials of Korangi Industrial area police station (PS).

The petitioner alleged that officials of said PS took away seven buffaloes and later foisted a case against his son Mustaqeem.

MEDICAL BOARD: A division bench of the Sindh High Court on Tuesday ordered setting up of a medical board to examine Mohammed Ishaq, former Chairman of RECP, an accused in an Ehtesab reference.

The bench, comprising Justice Sarmad Jalal Osmany and Justice Musheer Alam, was seized with the confirmation of interim bail granted to the accused against a solvent surety of Rs200,000.

Mohammed Ashraf Qazi, advocate, counsel for the accused, relied on medical grounds for confirmation of bail. The bench after hearing the counsel for the applicant, ordered constitution of a medical board. The SP of Central Prison Karachi was directed to move the higher authorities for medical examination of the accused/applicant.

The accused was booked in Ehtesab Reference 38/2000. Former federal minister Ahmed Mukhtar, former federal secretary Salman Farooqui, Brig Aslam Qureshi, Riaz Lalji are co-accused in the reference.

According to the prosecution, the accused sold rice at price lower than prevailing in the international market, thereby causing a loss of Rs 60.78 million to the national exchequer.

The same bench also disposed of a constitutional petition filed by Ms Raeesa, mother of alleged detenue, Shaukat Hayat.

Earlier on July 28, Nazir of SHC Moinuddin Ahmed recovered the accused from PS Korangi. The accused identified himself as detenue Shaukat Hayat but SI Mohammed Bakhsh told the Nazir that alleged detenue is Aslam and is wanted in a dacoity case. The Nazir directed the said police official to produce the alleged detenue before the court on July 30.

When the detenue was produced before the bench, he stated that he is also known as Aslam. He also stated that the petitioner is her step-mother.

After this statement, the bench disposed of the matter as infructuous. Javed Akhtar represented petitioner Raeesa.—APP
