KARACHI, July 8: The Sindh High Court has restrained the Station Commander, Station Headquarters, Karachi Cantt, from dispossessing the plaintiff, Shaikh Masood Abdul Rahman, from the nursery on the land situated in survey No 195, near Regent Plaza.
Justice Zahid Kurban Alavi passed the order while directing the defendant that he could take any action against the plaintiff only through the due process of law.
The plaintiff, who is represented by Zafar Iqbal, advocate, is proprietor of Cosmos Golden Garden and has already filed a suit for declaration and permanent injunction.
According to facts of the case, the plaintiff had entered into an agreement on November 4, 1999 with the defendant for five years for the use of the above-mentioned land. The deal was effective from November 3, 1999. However, rent at Rs 20,000 was effective from February 1, 2000. The plaintiff claimed he spent Rs2.2 million on the improvement of the land for starting his business.
On June 17, 2002 in a letter dated June 3, 2002 the plaintiff was asked to clear the site and remove the material by June 20, in the suit valued at Rs50,00,000.
