KARACHI, Dec 12: The Sindh High Court restrained a builder on Friday from raising construction in violation of the approved plan and from creating third party interest.

The order was passed by a division bench consisting of Justices Mrs Qaiser Iqbal and Syed Mahmood Alam Rizvi on a petition moved by Tanzeem-i-Askari, Dastagir Society, Federal B Area, through Advocate Haider Imam Rizvi.

The petitioner society said a builder was raising a six-apartment structure in violation of the approved plan and building regulations on a plot (LS 82/8A, Dastagir Society) opposite a mosque maintained by it. No parking space had been provided and government land had been encroached upon. The unauthorised portions demolished by the Karachi Building Control Authority had been rebuilt, the petition alleged. Directing the builder to strictly adhere to the sanctioned plan and regulations, the bench ordered that no third party interest would be created by the respondent builder till the next date of hearing to be fixed by office.

Bail granted

The bench granted bail to accused Mohammad Rehan Baloch in a spurious drugs case registered by the Federal Investigation Agency (FIA).

According to the prosecution, Rehan and his father, Majeed Baloch, owned a shop at the Burhani Centre, M.A. Jinnah Road. A raid conducted by the provincial drugs inspector and an FIA inspector on Sept 12 yielded a huge quantity of unregistered and spurious drugs and packing material. An incomplete charge-sheet was submitted before the drugs court, which was proceeding with the trial. The trial court dismissed Rehan’s bail plea.

The applicant said the shop had been rented out by him to a pharmacist and he had been implicated because he resisted the prosecutors’ demand for illegal gratification. He joined investigation of the case voluntarily. Nothing had been recovered from him and the only evidence on record was the testimony of his tenant. Investigation was still in progress and he was being punished before conviction.

The bench allowed him bail in the sum of Rs100,000.

Unauthorised constructions

A division bench of the Sindh High Court comprising Justice Qaiser Iqbal and Justice Mehmood Alam Rizvi on Friday directed the court’s nazir to obtain the inspection report from the Karachi Building Control Authority (KBCA) on the alleged unauthorised constructions near the Quaid-i-Azam mausoleum, PPI adds.

Petitioners Chaudhry Mohammad Anwar, Tahir Hussain and Ghulam Mohammad, residents of Abdul Qadir Arcade, Fatima Jinnah Colony, had moved the court against the construction of a high-rise commercial-cum-residential project on a plot (No.222) at Jamshed Quarters.

The bench directed the nazir to obtain the report from KBCA and forward it to the architect and submit a compliance report within two weeks.

Release of salaries

The Sindh High Court on Friday issued notices to the Sindh chief secretary, AG and criminal prosecution services secretary on a petition seeking release of salaries of criminal prosecution services department employees posted in Karachi.

Petitioner Waqar Ahmed and 16 others submitted through advocate Ilyas Awan that they were appointed on a regular basis as naib qasid, watchman, sanitary workers in the department in February 2008.

They were posted in different courts and offices in Karachi and received salaries only in March 2008. Later, a committee headed by Additional Secretary (Administration) Nazir Kalhoro was formed for a scrutiny of workers and their salaries were stopped.

The petitioners made written requests to the Sindh chief minister and law department but in vain. Their counsel submitted to the court that the new government had stopped salaries of the petitioners as they were recruited by the caretaker government. Employees of same department appointed in Larkana, Khairpur, Thatta, Nawabshah and Hyderabad districts were regularly getting salaries, he claimed. The division bench comprised Justice Khilji Arif Hussain and Justice Dr Qamaruddin Bohra.
