KARACHI, Oct 20: A division bench of the Sindh high court, comprising Justice Sarmad Jalal Osmany and Justice Syed Sajjad Ali Shah, on Friday directed an assistant sub-inspector of the anti-dacoity and robbery cell Saddar to submit details of a case in which an under-trial prisoner, Ghulam Bari, had been booked.

The accused was tortured during illegal custody for 13 days and booked in a 17-year- old case of murder after notices were issued in a constitutional petition filed by his brother, Ghulam Farid.

“Whatever evidence you have pertaining to this person regarding the alleged case be produced before us on Nov 8, “the bench ordered the ASI, Sarwar Sultan.

Dr Shoaib, In charge of the Surgical Ward -III of Civil Hospital Karachi, also appeared before the court and explained medical report in respect of Ghulam Bari.

Earlier, the court on Wednesday rejected a hand-written medical report by Dr Shoaib and summoned him to explain the same in person.

The bench, after statement of Dr Shoaib, adjourned further hearing till Nov 8 with directives to the prosecution to come up with all evidence against the accused. Mehmood A. Qureshi appeared for the petitioner.

NAB reference: The National Accountability Bureau Sindh on Friday filed a reference against regional income tax commissioner for misuse of powers, bribe, malpractice and causing loss to the national exchequer.

Abrar Ahmed is accused of illegally accumulating wealth and making 15 properties without his known sources of income and made assets worth more than Rs150 million.

The reference has been filed against him in the accountability court-V.

Appeal dismissed: The Sindh High Court on Friday dismissed an appeal filed by two activists of the banned Lashkar-i-Jhangvi upholding their death sentence in a sectarian killing case.

Ataullah and Mohammad Azam were sentenced to death by an anti-terrorism court in Karachi for killing Syed Athar Hussain Rizvi on May 3, 2001, in Korangi. The appellants preferred appeal against their conviction and prayed the court to set aside the trial court order, claiming innocence.

SHC's division bench, comprising Justice Rehmat Hussain Jaffery and Justice Ms Yasmeen Abbasey, after perusal of evidence and hearing arguments of the state and the appellants, for reasons to be recorded later, dismissed their appeal and maintained the death sentence awarded to them by the trial court.

BAIL granted: The Sindh High Court granted bail to two directors of the Makran Fisheries after an assurance by the National Accountability Bureau that the applicants were willing to refund the defaulted loan.

Azharul Hasan Butt and Mansoorul Haq were arrested by NAB in a bank default case and reference has been filed against them in an accountability court on the complaint of State Bank of Pakistan.

According to the NAB, the Makran Fisheries obtained loan from the Bank of Kyber, the Saudi Pak Commercial Bank and the KASB bank in aggregate sum of Rs1,275,184 million but defaulted, and the State Bank sent three references to the NAB against the directors of the firm for their wilful loan default.

Deputy prosecutor general NAB, Brig (retd) Shafat Nabi Sherwani, told the division bench of SHC that four directors of the firm, Azharul Haq, Mansoorul Haq, Tanveerul Haq and Imtiazul Haq, have expressed their willingness to repay the loan to the banks and have signed an agreement on Oct 12 according to which they will furnish Rs1,500,723 million thorough the assets of the Makran Fisheries.

The court, after assurance by the NAB, granted bail to the petitioner.— APP/PPI
