KARACHI, Aug 5: A Sindh high court bench, comprising Chief Justice Sabihuddin Ahmed and Justize Zia Pervez, issued a notice to the registrar of the Federal Urdu University for Arts, Science and Technology for August 24 in a petition against a new election to academic staff committee for nomination of university teachers’ representatives to the university senate and syndicate.
Assistant professor Nasir Abbas alleged through Advocate Mohammad Ali Abbasi that balloting to elect the nomination committee was held at the university’s Moulvi Abdul Haq campus and he polled 50 votes against 49 secured by Prof Abdul Malik, his nearest rival. Instead of notifying his name, the registrar issued a notification saying the two candidates were tied at 49 votes each after a fresh scrutiny and recount and that the poll would be conducted afresh.
The petitioner submitted that he was never put on notice of recount or scrutiny despite being the winning candidate. An adverse decision was taken against him without affording him an opportunity of hearing. The proposed new poll was unwarranted and he prayed that he should be declared a member of the nomination committee in accordance with the election result.
The bench asked the university to produce the election and recount record on Aug 24.
SHC ORDER: The Sindh High Court on Friday ordered the provincial law officer to place material against two alleged activists of the banned outfit, detained under anti-terrorism law, adds PPI.
The direction came in petitions filed by Ms. Fatima Asim against the detention of her spouse Mohammad Asim Khan, and by Ms. Naheed Fatima against the detention of her son Junaid Mohsin Alvi.
Both the detainees were arrested by the police following a crackdown against banned religious organizations on July 20 from Sharea Faisal.
They said the detainees were booked under 11-EE of Anti Terrorism Act but the administrative judge of the ATCs in Karachi ordered their release on bail.
The police, they alleged, despite accepting the surety papers did not release them and sent them to jail.
Challenging their detention, petitioners’ counsel Maqboolur Rehman submitted that the detainees were kept illegally.
He said the detainees are not affiliated with any religious or political organization and prayed the court to release them and direct the respondents to produce cases, if any, against them before the court.
The counsel placed affidavits of 11 persons of the area, stating that the detainees were not released despite bail.
He also placed letter of police (dated Feb 16) suggesting that the detainees were not involved in any criminal activities and recommended their ouster from fourth schedule of anti-terrorism act.
SHO of Sharea Faisal police informed the court that the detainees were kept in prison under section 11-EEE of the Anti Terrorism Act. AAG Sarwar Khan requested time for scrutinizing the matter.
SHC’s division bench, comprising Chief Justice Sabihuddin Ahmed and Justice Zia Pervaiz, granting request directed him to place material against detainees on the next date of hearing which was fixed for Aug 9.
