KARACHI, May 12: The Sindh High Court on Thursday set aside the conviction of deputy chief of Harkatul Mujahideen Al-Alami Mohammad Haneef in Marina club car bombing case and ordered his release if not involved in other cases. Haneef was sentenced to aggregate 39 years in prison with a fine of Rs one million by the Anti-Terrorism Court in Karachi on December 21, 2002.

Prosecution stated that he masterminded car bombing outside the Marina club in the limits of Gizri police station on new year eve in 2002.

Defence counsel Abdul Waheed Katpar argued that the prosecution could not prove its case before the trial court against his client.

Mr Katpar further questioned the identification parade of the appellant conducted after two weeks of his client’s police remand in the said case.

He said that IP had no value as photos of appellant were published in newspapers after his arrest. Assistant Advocate General Habib Ahmed supported the trial court order and prayed the court to enhance the punishment of convict.—PPI
