PESHAWAR, Oct 20: The Peshawar High Court accepted on Monday an appeal of a juvenile offender and set aside his conviction by a trial court in a murder case.

A single bench of the court, comprising Justice Tariq Pervez, observed that there were a number of conflicts between the evidences of different witnesses.

The appellant, Enyatur Rehman, was sentenced to five-year imprisonment and was ordered to pay Diyat money to the deceased’s family.

The appellant was accused of killing Shah Gul Amir in Mardan on July 21, 2002. He was 14-year-old at the time of occurrence.

Advocate Bashir Khan Tanghi appeared for the appellant and argued that the witnesses had recorded conflicting evidences before the trial court.

He argued that the complainant had claimed that they heard noise outside their residence and when they came out they spotted the appellant had killed his son.

He said that the place of occurrence was away from the residence and it was not possible for the complainant to hear noise of the occurrence at his residence.
