KARACHI, Aug 2: An ant-terrorism court sentenced on Saturday two accused to death for killing a police constable.

Judge Haq nawaz Baloch of the ATC-5 also awarded multiple sentences, including life term, to Kashif Aziz alias Kashif Mota and Mohammed Zahir, who had killed PC Mehboob Ali and wounded Sub-inspector Abdur Rauf and Head Constable Mohammed Rafique on January 13 in the compound of the Saudabad police station.

Special public prosecutor Mazhar Qayyum examined in all 17 prosecution witnesses, five of them eye-witnesses, in the case.

According to the prosecution, five suspects were spotted by a Saudabad police party in a stolen car (AAB-588).

As the suspects got down of the car one of them hurled a fire cracker. Then the suspects snatched a sub-machine gun from a constable and opened fire killing PC Mehboob instantly and injuring two other policemen.

The five suspects then fled the scene. Later on April 3, the Orangi Town police arrested Kashif and Zahir, who were handed over to the Saudabad police for investigation.

Both accused were sentenced to death for the crime under section 302 (b) of the Pakistan Penal Code “for committing Qatle Amad of PC Mahboob”.

The judge also awarded them the capital punishment “for committing an act of terrorism under Section 7 (a) of the Anti- terrorism Act, 1997.” They were also fined Rs50,000 or would have to undergo a six-moth term in lieu of the payment.

Both accused were sentenced to suffer life term under Section 3 of the Explosive Substance Act, 1908, for possessing explosive material. The judge also ordered the forfeiture of their entire movable and immovable properties.

The two a were also sentenced to a two-year term under section 397, 186 353 and 34 of the PPC.

The judge sentenced the two accused to suffer a 10-year term under Section 337-D of the PPC for injuring SI Abdul Rauf.

Another seven-year term was handed down to Kashif Aziz and Mohammed Zahir for injuring HC Mohammed Rafiq, under Section 337-F (vi) of the PPC.

Both accused were sentenced to a 10-year term and to pay Rs50,000 each. They will have to suffer an additional six-month term in case of default on the payment. The judge also ordered both accused to pay Rs100,000 each as compensation to the families of their victims.

The judge sentenced Kashif Aziz to a seven-year term and a fine of Rs50,000 for possessing an unlicensed pistol. The accused will suffer an additional six-month term in case of default.
