Govt view sought in Khwajas’ case

LAHORE, Jan 7: The Lahore High Court on Tuesday while issuing notices to the federal and Punjab governments on a plea against the detention of five members of the Khwaja family called for separate replies by Jan 15.

The court also directed Deputy Attorney-General Malik Pervez Akhtar and the Punjab advocate-general to seek instructions and appear.

Replying to a court query, DAG Malik Pervez Akhtar said that the detention order against Khwajas was passed by the federal government under Section 3 of the Security Act of Pakistan for their involvement in anti-state activities on behalf of foreign country agencies.

He said they were in the custody of the Punjab government and were detained in Chuhng sub-jail.

The court also advised the petitioner’s counsel that meanwhile the petitioner might present representation against the detention to the authorities concerned on which counsel Hamid Khan said that for moving a representation, a meeting of detenues and their lawyers would be necessary, which the court allowed.

The petition was filed by Hamid Khan on behalf of Umatul Jalil, wife of detained Dr Ahmad Javed Khwaja, against the detention of her husband as well as Ahmad Naveed Khwaja, Dr Umar Karar Khwaja, Khizar Khwaja and Usman Ali.

The court would hear the detention petition with the main petition of habeas corpus filed by the petitioner previously.

Dr Ahmad Javed Khwaja, Ahmad Naveed Khwaja, Dr Umar Karar, Dr Khizar Ali, and Usman Ali were presently in the custody of the Punjab government.

Pervez Inayat Malik and Naveed Inayat Malik also appeared from the petitioner’s side. Sundas’ plea: A division bench comprising Justice Tassadduq Hussain Jillani and Justice Ali Nawaz Chouhan of the Lahore High Court on Tuesday admitted an application of Sundas Farooq against her victimization by lawyers and two ex-cops on Oct 16 at Aiwan-i-Adl.

The court will hear the application along with her application for the cancellation of bails of SI Nazar Anis and ASI Akbar.

She submitted that when she left the court after the hearing of his case against the cops involved in highhandedness and victimization, respondent’s lawyers Rai Bashir Ahmad, Burhan Moazam Malik, Haider Zaman and others attacked and tortured her and also detained her for some time in bar room.

She requested the court to provide her protection and take action against the responsible lawyers and cops.
