ISLAMABAD, Nov 13: President Gen Pervez Musharraf on Wednesday promulgated an ordinance under which Police Order-2002 cannot be implemented in the Islamabad Capital Territory (ICT) till the local government is established.
The ordinance, known as Police (Amendment) Order-2002, will come into force at once and would be deemed to have taken effect on August 14, 2002.
The amended ordinance says that in Police Order-2002 after the word “once” the words “except in the Islamabad Capital Territory where it shall come into force on the date the local governments assume office in the said territory” shall be added.
Meanwhile, a senior official of Islamabad police told Dawn that the new Police Order-2002 could not be implemented in Islamabad until the local government was established there.
He said matters related to the future district Nazim and judiciary could not be entertained under the present system in the capital.
Elaborating some important aspects of the Police Order-2002, the official said the act had been made more accountable for the police.
Giving details about the new structure of police in Islamabad, he said there would be a capital city police officer who would be appointed in place of the inspector general (IG). He would be a 21 grade officer. There would be two SSPs in Islamabad; SSP operations and SSP investigation.
The SSP investigation would investigate cases related to offence against persons, loss of property and car-lifting, while SSP operation would deal with matters related to the working of police.
Under the Police Order-2002, cases would also be registered against police officials for their negligence and criminal act, if any.
Under the new order, police personnel will face five-year imprisonment and fine if they are found involved in unlawful acts.
In case of non-production of any accused before the court within 24 hours, the relevant investigation officer will be awarded one-year imprisonment and fine.
Imprisonment for three years and fine will be awarded to those police officials who will be found intoxicated. Now police cannot arrest or detain any person without lawful reasons. Similarly, the police cannot torture any accused in custody.
In case of violation of these rules, the relevant police officials will be sent behind bars for five years.
