ISLAMABAD, Oct 24: The Election Commission is holding an inquiry as to how Imtiaz Sheikh, candidate from PS-11 (Shikarpur-III), was declared winner, despite having received the information from the returning officer concerned that Agha Tariq of the People’s Party Parliamentarians had won the election.
Interestingly, the name of Imtiaz Sheikh was declared as winner when unofficial results were declared. His name was also notified after 10 days in the official gazette.
But the returning officer, even after recounting, declared Agha Tariq as winner. “We are holding an inquiry that how it all happened and who is responsible for that,” an official of the commission said.
Election Commission secretary, who is also spokesman for the EC, was not available for comment as he remained in meeting with the chief election commissioner till late night.
ELECTION TRIBUNALS: The Election Commission on Thursday appointed 19 judges of the high courts who would act as election tribunals for hearing and disposal of election petitions.
An announcement by the EC said that seven judges from Lahore High Court, five from Sindh, five from NWFP, and two from Balochistan, have been appointed to act as election tribunals.
It said election to the National Assembly and Provincial Assemblies could not be challenged except through an election petition.
The law provided that the election petition should be presented to the secretary of the Election Commission in Islamabad within 45 days from the publication of the results in the official gazette.
The judges from LHC, who would act as election tribunals are: Justice Syed Jamshed Ali, Justice Syed Zahid Hussain, Justice Mian Hamid Farooq, Justice Pervaiz Ahmad, Justice Rustam Ali Malik, Justice Tanvir Bashir Ansari and Justice Syed Sakhi Hussain Bokhari.
Five justices from SHC are: Justice Amir Hani Muslim, Justice Ghulam Rabbani, Justice Syed Zawwar Hussain Jaffery, Justice Mohammad Moosa K. Leghari, and Justice Mohammad Sadiq Leghari.
Five judges from Peshawar High Court, who will hear election petitions from NWFP and FATA, are: Justice Mrs Khalida Rashid, Justice Tariq Pervez, Justice Abdul Rauf Khan Lughmani, Justice Shah Jehan and Justice Dost Mohammad. Two judges from Balochistan, Justice Amanullah Khan and Justice Akhtar Zaman Khan Malghani would act as election tribunals.
