KARACHI, Sep 10: Justice Shabbir Ahmed of the High Court of Sindh withdrew on Tuesday the non-bailable warrants (NBW) of arrest issued against the city Nazim, Naimatullah Khan, after the alleged contemnor tendered unconditional apology.

The judge was hearing a civil miscellaneous application for contempt of court filed by a litigant in a dispute over plot L-1, Survey I, situated at the Old Sabzimandi on which there is a factory since pre-independence days.

“Col Iftikhar of the 5 Corps, appearing on notice, assured the court that the troops engaged in the development of a park will vacate the factory premises within a week and its possession will be handed over to the person from whom the possession was taken over. Col Iftikhar will intimate Hamid Husain, the receiver appointed by this court. The NBW issued against the city Nazim on account of non-responsive attitude is withdrawn. The receiver will submit report on vacation of the factory,” the court said in its order while disposing of two contempt applications and reference filed by the receiver of the SHC.

Earlier Col Iftikhar, appearing in the court, expressed ignorance about the civil dispute. The court told the officer that officers and troops misbehaved with the officials of the SHC despite proper identification by the court officials. Col Iftikhar submitted that if the men were identified, action would be taken against them and a report would be submitted before the court.

The judge also expressed annoyance at the attitude of Manzoor Ahmed, counsel for the City District Government Karachi, and said the court had no business with the city Nazim, but he was required to appear in the court. — APP
