KARACHI, Oct 9: The prosecution prayed on Saturday to an anti-terrorism court to award capital punishment to a worker of the Harkatul Mujahideen Al-Aalmi in a murder case.
Judge Haq Nawaz Baloch of the ATC-5 fixed Oct 12 for the pronouncement of judgement after hearing final arguments from special public prosecutor Mazhar Qayyum and defence counsel Ghulam Qadir Jatoi.
Kamran alias Asif alias Uncle alias Mehmood, who carried Rs3 million reward on his arrest, was charged with killing a passerby woman and attempting to kill policemen during a shootout with police on May 19 in Sector 15-A, Buffer Zone, under Sections 302, 353 and 324 of the Pakistan Penal Code. He was also charged with possessing arms and ammunition and explosive material.
The special public prosecutor stated that the accused was injured and arrested red-handed after Inspector Usman Asghar, along with a police party, raided house No R-1272, Al- Mubashir Building.
He stated that the prosecution had successfully proved its case against the accused beyond any shadow of doubt.
Mazhar Qayyum submitted that Kamran, along with an absconding accomplice, Junaid, opened fire on the police party to avoid arrest. The two accused ran away in different directions and Kamran took position behind a pile of cement blocks.
He said Kamran fired upon the chasing party and killed Sarwar Bibi, a domestic servant, in the shootout. He said the accused was also hit by two bullets in his lower torso and was arrested with an unlicensed AK-4 assault rifle (Kalashnikov) and eight handgrenades in the presence of public.
The prosecutor stated that later accused led the police to the recovery of five RPGs (rocket-propelled grenades), five initiators, eight handgrenades, 200 live rounds of Kalashnikov, four phone bombs, a video-cassette bomb, 25 electronic circuits meant for explosive devices and a box containing anti-US material and bomb making techniques from his hideout.
He submitted that the accused was a member of a proscribed organization and was also involved in other cases, including a case pertaining to an attempt on the life of President Musharraf.
The prosecutor, who in all 12 prosecution witness, submitted that private and independent evidence was successfully brought on record which clearly proves the red-handed arrest of the accused and recovery of a sizable quantity of arms and ammunition. He also referred to the testimony of a milk-seller, who was also present at the scene when the accused and police exchanged fire.
Defence counsel Ghulam Qadir Jatoi prayed to the court to acquit his client as he was implicated in the case by the police.
The defence counsel said all the prosecution witnesses were policemen and the accused was involved in the case by the police to claim the reward money announced for his arrest. The seizure from the hideout also included over 150 books on different topics.
KIDNAPPING CASE: Judge Arshad Noor Khan of the ATC-3 put off hearing of a kidnapping-cum-murder case against two accused after the prosecution closed its side.
The judge fixed Monday for recording the statements of accused, Khurrum Mushtaq and Ather Mehmood, being prosecuted for kidnapping Raghib Hussain around 11.30am on April 1 in Gulistan-i-Jauhar.
Hours after, the victim was found unconscious near Singapore Towers in Sharea Faisal police limits and died at the hospital bed after a couple of weeks.
According to prosecution, on April 2, Raghib told his mother that he was kidnapped by his friend, Sheeraz, who posed him as a girl on the internet. It was alleged that on March 31 the impostor asked him for a date.
Absconding accused Sheeraz and Shabana allegedly kidnapped him at gunpoint and took him to a bungalow in Gulistan-i-Jauhar where accused Khurrum, Asif and Ather were already present. Accused Asif allegedly injected a syringe in his chest as the other accused caught hold of him. After a little while Asif allegedly injected another syringe in his chest and he fell unconscious.
The kidnappers allegedly phoned the victim's mother and demanded Rs1 million for the release of their son. Later, the kidnappers again phoned the woman and told that her son was lying near Singapore Towers.
The victim died at the hospital on April 16 and his mother informed the Gulistan-i-Jauhar police about the incident.
Later, on July 26, SI Adnan arrested accused Khurrum and Ather. Special public prosecutor Naimat Ali Randhawa examined in all 13 prosecution witnesses.
