KARACHI, Aug 5: The Sindh High Court on Thursday appointed Fauzia Rasheed as commissioner to visit the site where a 200-foot high phone tower is being installed by the Ufone and submit a report about the existing position of the site whether the tower is already operational or not.
SHC's division bench, comprising Justice Anwar Zaheer Jamali and Justice Gulzar Ahmed was hearing the petition against installation of phone tower in DHA, Karachi. The court also asked the commissioner to arrange photograph of the site to show the position of the site and fixed the matter for Aug 12.
Dr. Nazir Ahmed Chudhary, Shahid Paracha and Bushra Hasan submitted that the Ufone company was installing a 200 feet high phone tower in the Third Central Lane Phase-II DHA, adjoining their residences.
It was their contention that the tower is being set up without obtaining prior permission and in violation of construction bylaws of DHA, and that no precautionary steps have been taken by the respondents.
In these circumstances, they submitted, construction of phone tower will be hazardous to their lives and properties. Citing the ministry of communications, the PTCL, GM Southern Telecommunication Region IV, DE and Ufone company as respondents, the court was prayed to declare installation of a tower in residential area illegal and restrain the respondents to activating the telephone tower.
PLEA DISMISSED: An anti-terrorism appellate bench of High Court of Sindh, comprising Justice Mohammad Mujeebullah Siddiqui and Justice Mohammad Afzal Soomro, on Thursday dismissed an appeal filed by the state challenging acquittal of two accused in a police encounter case.
According to prosecution, Shahid alias Lamba and Yousuf were arrested by a police patrol party while they were looting passengers of a minibus W-25 on April 3, 2000. When challenged by police, they opened fire due to which a police official Shahid Akhtar was injured and later succumbed to his injuries.
The accused/respondents were arrested on April 14, 2000. They were tried and acquitted by an ATC on Aug 9, 2000, against which the instant appeal was filed. The ATA bench of SHC, after hearing the counsel for state and counsel for respondents, dismissed the appeal.
RELEASED: A division bench of High Court of Sindh, comprising Justice Mohammad Mujeebullah Siddiqui and Mohammad Afzal Soomro, on Thursday disposed of a detention petition challenging illegal detention of one Shahid Amin.
Earlier Superintendent of Karachi Central Prison appearing before the bench on notice submitted that he had received surety papers of Zahid Amin from a court in Punjab after which detenue was released forthwith before sunset on Wednesday.
The counsel for the petitioner did not dispute the statement after which the court disposed of the matter holding that the grievance of the petitioner had been redressed and thus the petition had served its purpose. -PPI/APP
