KARACHI, Aug 30: A division bench of Sindh High Court, comprising Justice Wahid Bux Brohi and Justice Muhammed Mujeebullah Siddiqui, on Friday ordered constitution of a medical board immediately to examine and report about condition of an accused.
The bench was hearing a contempt of court application filed by counsel for Allah Dino Dahri, a former executive engineer in Communication and Works Department, who is an accused in an accountability reference.
The contempt application was moved by the counsel for accused when he was shifted from a private hospital to Civil Hospital. Earlier, a bench of SHC ordered that the accused be admitted in the private hospital.
When the contempt application came up for hearing, the counsel for applicant submitted that shifting of the accused was in violation of the court orders.
Advocate General Sindh, Raja Qureshi, Assistant AG, Arshad Lodhi and Dilawar Hussain, counsel for NAB, opposed the application.
The bench after hearing both the sides ordered that the accused be shifted back to the Munawwar Hospital. The bench also ordered that a new medical board be constituted immediately. The bench also ordered that the report of the medical board shall opine that whether keeping of the accused in jail is hazardous or detrimental to his health.
The state counsel were also asked to submit the report by Sept 3.
According to prosecution’s reference against the accused, he in connivance with his son-in-law and co-accused Pervez Ahmed Dahri, absconding in the case accumulated wealth amounting to Rs2,3851,858.
The property include agriculture land in Nawabshah, Dadu, houses, bungalows and flats in DHA, Clifton, Nawabshah, Hyderabad etc. The accused also maintained a number of bank accounts in his name, wife and daughter’s names besides his son-in-law. — APP
