Subhani bailed out

LAHORE, May 2: A special appellate division bench of the Lahore High Court on Thursday granted bail to former provincial minister Khush Akhtar Subhani on medical ground against surety bonds of Rs2 million.

The court also directed the deputy prosecutor general that if the petitioner misused the bail, the NAB could file an application for its cancellation. The court also ordered to place the name of the applicant on ECL.

The DPG opposed the bail plea, and said his treatment was possible in jail. He informed the court that the applicant refused to give tests, including biopsy.

Aitzaz Ahsan, the counsel for the applicant, informed the court that the doctors concerned forced his client to sign the papers as biopsy was a fatal test and state of health was very serious. He said the applicant needed special treatment and the doctors also advised him treatment outside jail. In this regard, a report of the Shaikh Zayed Hospital was also produced in the court.

The court in its decision stated that the applicant was entitled to get bail according to the criteria laid down by the Supreme Court in same nature cases.

The applicant’s counsel informed the court that his client was suffering from Hepatitis-B and a medical board had already examined him and declared him serious.

The bail application filed by Subhani submitted that the NAB arrested him in March, 2001, for misappropriating funds in the construction of community centres and making illegal assets beyond his known sources. He submitted that he was in solitary imprisonment in jail and was suffering from Hepatitis-B. He said his treatment was not possible in jail.
