FBR told to decide case on merit

ISLAMABAD, Feb 12: Federal Tax Ombudsman Justice (retd) Munir A. Sheikh has asked the Federal Board of Revenue (FBR) to consider the case of a complainant on merit.The FTO issued these directives on the complaint of M/s Chiniot Enterprises (Pvt) Limited, Haripur against the Sales Tax Department, Peshawar, which rejected the refund claim of Rs127,112 filed by the complainants on the ground that suppliers, Owais Trading Company, had an ‘abnormal profile’ based on verification of supplier’s invoice.

The FTO ruled that the decision to reject the complainant’s claim appears to have been taken without taking into consideration full merits of the case. He ruled that the department had committed an act of maladministration.

The FTO recommended to the FBR that the refund claim made by the complainant shall be deemed to be pending and shall be considered in the light of the findings withstanding the abnormal profile.

The complainant shall also be associated and action to be completed in one month on the date of receipt of the recommendation, says a statement issued here.—APP
