KARACHI, Oct 12: The Sindh High Court on Thursday, vacating a stay in an illegal construction case, ordered the Karachi Building Control Authority to demolish five flats raised in parking area of multi-story building in Civil Lines area and submit compliance report within four weeks.

SHC's division bench, comprising Justice Mushiar Alam and Justice Maqbool Baqar, was hearing an appeal of Ghulam Mohammad who challenged the illegal construction of flats in parking area of Uzma Apartments.

The court earlier on Jan 28, 2004, disposed of the petition with directives to the KBCA to demolish the illegal flats raised in parking area. However, on April 6, 2004, the flat owners obtained ex parte stay order by filing an application.

During hearing of the application against the stay, it was contended by the appellants' counsel Rasheed A Rizvi and Syed Hayder Imam Rizvi that interveners have admitted the illegal construction of the flats in parking area in their affidavits.

The court, after hearing the case, vacated the stay and directed the KBCA to demolish the illegal construction and submit compliance report within four weeks.

CHEMICAL EXAMINATION: The Sindh high court on Thursday directed the investigation officer for chemical examination of remaining samples of seized charas within 15 days in a plea seeking directives against life imprisonment verdict in narcotics case.

Bilal and Dost Mohammad have filed a plea expressing dissatisfaction over the judgement announced on Nov 24, 2005, by a trial court which had sentenced them to life imprisonment.

The appellants were convicted in a case in which total 372 kilograms of charas had been seized by the police from a passenger bus arriving from Norther Areas to Karachi.

Saifullah, counsel for appellants, submitted that only two samples out of the total seized quantity had been chemically examined, though the report of the tests was positive, but 20 more samples out of total quantity are still unexamined.

The Division Bench, comprising Justice Anwer Zaheer Jamali and Justice Zawar Hussain, directed the investigation officer Fareedullah to send the remaining samples for chemical tests.

It was also submitted that appellants were innocent and falsely implicated in the case.
