ISLAMABAD, Jan 19: Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry on Thursday stressed that justice should be provided to the poor on doorstep and if an employee was removed from service he should be permitted to approach the district court of his hometown for legal remedy. The chief justice made this observation while hearing cases of service matters here on Thursday.
Justice Iftikhar said these cases would be disposed of on Friday after hearing arguments of the remaining counsel appearing on behalf of the appellants and respondents. He directed all the counsel and respondents to appear before the court at 9.00 a.m. because “we want to dispose of these cases on Friday till 10.30 a.m.”
A court adjourned proceedings of thousands of appeals related to service matters for Friday.
The nine-member bench comprises Justice Rana Bhagwandas, Justice Javed Iqbal, Justice Abdul Hameed Dogar, Justice Faqir Muhammad Khokhar, Justice Mian Shakirullah Jan, Justice M. Javed Buttar, Justice Tassaddaque Hussain Jillani and Justice Syed Jamshed Ali.
Abdul Hafeez Pirzada, Waseem Sajjad, Abdul Mujeeb Pirzada and Syed Iftikhar Gillani and others completed their arguments on Thursday about Section 2-A of the Services Tribunal Act. 1973 and cited various judgments of the apex court.
Attorney General Makhdoom Ali Khan and Malik Muhammad Qayyum have already completed their arguments. Muhammad Akram Sheikh, who is representing over 600 appellants, has also completed his arguments. He contended that Section 2-A of the Services Tribunals Act was not ultra vires of the Constitution.
The bench is hearing arguments of the lawyers whether or not Section 2-A of the Services Tribunals Act is ultra vires of Articles 212, 240 and 260. Khalid Anwar also appeared.
The bench raised a number of questions about the vires of Section 2-A of the Services Tribunal Act 1973.
The chief justice said: “A workman of the government department has no right to approach the Federal Services Tribunal but a workman of the corporation has right to approach the same forum (Federal Services Tribunal) which shows anomaly of the statute.
