HYDERABAD, Aug 27: The provincial transition wing of the local government department has made it clear that the internal recall of any union council Nazim by the union council itself is invalid and shall be held in abeyance, until the village councils and neighbourhood councils in the union are constituted and vote upon the motions carried by the union councils.

The above-mentioned legal opinion came in the light of a letter written by the Naib Nazim of Union Council-12, Latifabad, pertaining to the passage of a no-confidence motion against the Union Council-12 Nazim, Umer Gaddi.

According to a letter, written by the assistant chief (legal), provincial transition wing, local government department, S. K. Awan, to the district coordination officer, Hyderabad, that it has been provided in section 85 of the Sindh Local Government Ordinance (SLGO) 2001 that any internal recall of the Union Council Nazim by the Union Council itself is invalid unless the village and neighbourhood councils are constituted and voted upon the motions carried by the union councils.

He clarified that as far as the internal recall of the Naib Nazim is concerned, under section 92 of the SLGO 2010, the internal recall of the Naib Nazim of Union Council is valid by itself and shall not be held in abeyance.

Mr Awan asked the DCO to take further action accordingly.

The matter was raised in the district council’s session on Aug 6 when Mohammad Yousuf Qureshi tabled a resolution, calling upon the National Reconstruction Bureau to strike down sections 85 and 92 of the SLGO.
