KARACHI, Jan 4: The Sindh High Court ordered on Friday the custody of a three-month-old girl to her mother, but directed her to approach the guardian court for the custody of her two and a half years old son, from her husband.
Justice Mohammed Ashraf Leghari passed the order while hearing a criminal miscellaneous application filed by Ms Shabana Shah.
The court directed the applicant to move the guardian court concerned for the custody of Master Syed Asama Ali Shah, two and a half years old.
Earlier, the counsel for petitioner submitted that both the minor children were detained by his client’s husband who maltreated the petitioner and forced her to leave his house.
He contended that Baby Alisba Eman was only three months old and a suckling baby.
The counsel for the respondent, Syed Sakhawat Ali Shah, said that the baby was feeding on powdered milk and, therefore, the custody could be retained by the father.
However disposing of the application, the court handed over the custody of baby to her mother.
